Military divorce
will involve issues, including where the children will live, how much child support will be paid and received, how much spousal support will be awarded and how property will be divided, including military retirement benefits. In a military divorce, it will be decided how much of the military retirement plan the nonmilitary spouse will be awarded. I am intimately familiar with military regulations and Virginia state law as they pertain to the division of military benefits, including survivor benefit plans, medical care at military medical facilities and health care benefits.
The Uniformed Services Former Spouses' Protection Act (USFSPA) allows state courts to divide military retirement pay between the military member and the nonmilitary spouse. Additionally, nonmilitary spouses may be awarded a portion of the retirement pay directly from the government in the event of a court order or a property settlement. Payments may be made for child support, alimony or spousal support and retirement pay. There is an involved procedure to make a request for direct pay, and I can assist you with this as well as all of the other issues that can arise.
