Property division is typically one of the most hotly contested parts of any divorce. According to Virginia law, there should be an equitable distribution of all marital property and debts between the two spouses. Equitable doesn't always mean equal. There are a lot of factors that come into play and things can get complicated quickly. It is important to have an experienced attorney on your side to ensure that your interests are protected.
At the Law Office of Stephen J. Kecskes, I work tirelessly to help clients reach agreements in property division disputes. I have been practicing family law in the Virginia Beach area for over 35 years. I have handled contested and uncontested matters and low to high asset distribution. I can also help with issues involving business valuation and other complex property division matters.
Committed To A Fair Settlement
In a contested divorce, the court, upon request of the either party, shall determine the legal title as between the parties, and the ownership and value of all property, real or personal, tangible or intangible, of the parties. The first step in a property division proceeding is to determine which of the property is marital property and which is separate property.
Once all property has been classified as marital or separate, the court shall determine the value of all property, including the following:
Real estate, including residences and time shares
Motor vehicles or boats
Civilian or military pensions, profit-sharing or deferred compensation plans, investments and retirement accounts
Debts, including mortgage, credit cards and income taxes
